Welcome to CharacterGen, an AI character generator designed for creating complete character designs with turnarounds, expressions, and poses. By accessing or using our service, you agree to be bound by these Terms of Service, including the Acceptable Use Policy set out below. If you do not agree with any of these terms, please do not use our service.
CharacterGen provides users with a comprehensive AI character generator platform to create complete character designs including turnarounds, expression sheets, pose references, and outfit designs. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.
CharacterGen is an independent platform and is not affiliated with, endorsed by, or sponsored by any of the underlying AI model providers whose technology we integrate (including but not limited to Google, OpenAI, Anthropic, KIE, OpenRouter, Replicate, and Stability AI). CharacterGen provides a custom interface and workflow on top of these third-party AI models.
When you use our service, you acknowledge and agree that:
- Prompt Processing: The text prompts and reference images you submit are transmitted to third-party AI providers to generate the requested output.
- Content Moderation: Every prompt you submit is screened by an independent content moderation service (Creem Moderation API) before generation begins. Prompts that violate our Acceptable Use Policy will be blocked and no credits will be consumed.
- Output Variability: AI-generated output is inherently probabilistic. We do not guarantee any specific result, quality level, likeness, or suitability for a particular purpose.
- User Responsibility: You are solely and fully responsible for the prompts you submit and for the content you generate, download, share, or use through our service. "The AI generated it" or "a third-party API produced it" is not a valid defense against misuse.
- Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
- Age Requirement: You must be at least 13 years old (or the minimum age required in your jurisdiction) to use CharacterGen. Users under 18 must have the consent of a parent or legal guardian.
All platform technology provided through CharacterGen, including but not limited to the character generator platform, user interface, source code, branding, and documentation, is owned by charactergen.app and protected under copyright law.
- You acknowledge that you do not own the underlying AI technology or the intellectual property that makes up the CharacterGen service, and you agree to respect the intellectual property rights of charactergen.app and any third parties.
- Ownership of Generated Content: Paid subscribers retain ownership of character designs generated using our service, subject to the underlying AI model providers' license terms. Free tier generated content is licensed for personal, non-commercial use only.
- Your Warranties: By submitting a prompt or reference image, you represent and warrant that you own or have all necessary rights to the input, and that neither the input nor the output will infringe any third party's intellectual property, privacy, publicity, or other rights.
You agree not to use CharacterGen — and not to use any content generated through CharacterGen — to create, upload, share, or distribute any of the following categories of content. This list is not exhaustive; we reserve the right to enforce against any material we deem harmful, whether or not explicitly listed.
- Child Sexual Abuse Material (CSAM) and any content that sexualizes, exploits, or endangers minors in any form — whether realistic, stylized, anime/cartoon, or otherwise.
- Non-consensual intimate imagery of real persons, including "revenge porn" or the sexualization of real identifiable individuals without verifiable consent.
- Face-swap, deepfake, or face-manipulation of real identifiable persons without their explicit consent, and any use of our service to create misleading likenesses of real people.
- NSFW, sexually explicit, or sexually suggestive content of any kind, including nudity, pornographic material, fetish content, or sexually provocative imagery.
- Hate speech, harassment, threats, or incitement to violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, nationality, or other protected characteristics.
- Graphic violence, gore, or glorification of self-harm, suicide, or eating disorders.
- Terrorism, extremism, or content that promotes or facilitates acts of terror.
- Illegal goods or services, including but not limited to drugs, weapons, counterfeit items, stolen goods, or human trafficking.
- Fraud, scams, impersonation, phishing, or misinformation designed to deceive, defraud, or mislead others.
- Intellectual property infringement, including copyrighted characters, trademarks, or branded material used without authorization.
- Malware, spyware, or any code intended to damage or gain unauthorized access to systems.
- Attempting to circumvent, bypass, disable, or defeat content moderation, safety filters, or rate limits — including but not limited to prompt injection, prompt splitting, obfuscation, jailbreaks, or use of third-party bypass tools.
- Using automated means (bots, scrapers, crawlers) to access the service without our prior written permission.
- Reverse-engineering, decompiling, or otherwise attempting to extract source code, models, or system prompts.
- Reselling, sublicensing, or redistributing access to CharacterGen without authorization.
- Interfering with or disrupting the security, integrity, or performance of the service or the experience of other users.
- Using the service for any illegal or unauthorized purpose, or in violation of any applicable law or regulation.
CharacterGen does not offer, promote, or permit uncensored, unfiltered, NSFW, 18+, or adult-content generation. Any attempt to use our service to offer such content to others is strictly prohibited.
To enforce this Acceptable Use Policy, every prompt submitted to CharacterGen is automatically screened before any AI generation is initiated. Prompts that are flagged or denied by our moderation system will be blocked, no generation will occur, and no credits will be consumed. We may also review generated content after the fact and remove content that violates our policies.
We do not store your prompts for any purpose other than providing the service, complying with law, and enforcing these Terms and the Acceptable Use Policy.
- Currency and Billing: Prices are displayed on our pricing page and charged in the stated currency. Applicable taxes may be added depending on your jurisdiction.
- Subscriptions: If you purchase a subscription plan (e.g., monthly or yearly), your plan will automatically renew at the end of each billing period at the then-current price, unless you cancel before renewal. The renewal amount and date are shown on your billing page.
- Credits: Paid plans include a set number of generation credits per billing period. Unused credits may or may not roll over depending on the plan; see the pricing page for details. Credits have no cash value and cannot be transferred.
- Price Changes: We may change prices with reasonable advance notice. Price changes will not apply to the current paid period of an active subscription.
- Payment Processing: Payments are processed by our Merchant of Record, Creem (Armitage Labs OÜ), and additional providers where applicable (Stripe, PayPal). By making a purchase you agree to the payment processor's terms.
CharacterGen is offered in multiple tiers (including a free tier and one or more paid tiers). Features, generation quotas, output quality, commercial-use rights, and support levels may differ between tiers. The current feature matrix is described on our pricing page and may be updated from time to time. We will not retroactively remove features from a currently paid billing period without notice.
You may cancel your subscription at any time:
- Directly from your account settings within CharacterGen, or
- Through the Creem Customer Portal (a link is provided on your billing page).
When you cancel, your plan remains active until the end of the current billing period, after which it will not renew. You will continue to have access to your purchased features and remaining credits until the end of the current period.
- Response Time: We respond to all refund requests within three (3) business days.
- When Refunds May Be Granted: Duplicate charges; charges after a confirmed cancellation; charges in error caused by our system; and other cases required by applicable consumer protection law.
- When Refunds Are Not Granted: Partial-month usage after the billing period has started; change of mind after substantial use of credits; violations of this Terms of Service or the Acceptable Use Policy.
- How to Request: Email support@charactergen.app with your account email and order ID.
We reserve the right, at our sole discretion and without prior notice, to:
- Block or filter any prompt, input, or output we believe violates this agreement.
- Suspend or terminate your account for any violation of these Terms or the Acceptable Use Policy.
- Revoke any license granted to generated content created in violation of these Terms.
- Forfeit remaining credits and deny refunds in cases of violation.
- Cooperate with law enforcement and report illegal content (including CSAM) to the appropriate authorities as required by law.
Suspension or termination for policy violations does not entitle you to a refund.
Your use of CharacterGen is also governed by our Privacy Policy, which describes what information we collect, how we use it, and the third-party service providers that process data on our behalf (including AI providers, the content moderation service, payment processors, and storage providers).
The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, suitability, or availability of the service, the AI-generated output, or the results of content moderation, and we disclaim all warranties to the fullest extent permitted by law.
To the fullest extent permitted by law, charactergen.app shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including damages arising from AI-generated output or moderation decisions.
You agree to indemnify and hold harmless charactergen.app, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service, your prompts or generated content, or your violation of these Terms or the Acceptable Use Policy.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which charactergen.app operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.
We reserve the right to update or modify these Terms at any time. Material changes will be announced by posting the updated version on this page and updating the "updated_at" date above. Your continued use of the service after any changes signifies your acceptance of the new terms.
